Michael Waltrip admitted to Scene Daily on Friday afternoon that it was his team that took the swaybar.

“It was a mistake,” Waltrip told Scene Daily. “Look at the back of these toolboxes. There are sway bars, there’s jack handles, and it wound up in our possession. We called them and said, ‘We want to give this back.”’

A person familiar with the incident who requested anonymity because he’s not authorized to discuss it also told The Associated Press it was Waltrip’s team.

UPDATE:

Toyota officials on Wednesday identified the Roush Fenway Racing part that owner Jack Roush said was found in a Toyota team’s possession during a Sprint Cup post-race teardown as a spring.

Jim Aust, the president and chief executive officer of Toyota Racing Development, said once the part was found to belong to RFR that it was returned. He was uncertain how the part, discovered on a table with other Toyota parts, got there or from which team it came.

“I don’t understand the whole procedure when a teardown happens,” said Aust, referring to a post-race process in which several cars are broken down by NASCAR inspectors. “The only thing I know is it wound up with parts we had and [which were] returned to Roush.

“It’s unfortunate it happened the way it did. It wasn’t anything intentional. There’s no reason to be done intentional. I have no idea how it happened to begin with.”

Roush Fenway president Geoff Smith said the part in question was not a spring, but he would not elaborate. No one at RFR has identified which Toyota team had the part.

“Jack is the only one to talk to at this time and he presently doesn’t want to make any additional comments,” Smith said.

ESPN the Magazine has an interesting and potentially explosive quote from Roush Fenway Racing co-owner Jack Roush as part of its 10th Anniversary issue, which is on newsstands this week. Two weeks ago at Atlanta Motor Speedway, the magazine quotes Roush as saying, “We had a proprietary Roush Fenway part go missing from one of my race teams, and we recovered it from a Toyota team. I’m not going to say which team it is, but we are considering legal action, or getting NASCAR involved.”

If Roush’s allegations prove to be true, this could become NASCAR’s version of the recent spy scandal that rocked Formula One racing, in which the McLaren-Mercedes team was caught with confidential, proprietary test information belonging to rival Ferrari. We contacted Roush Fenway Racing today in search of further information – including team was involved and the specific part in question — and we [SIRIUS Speedway w/ Dave Moody] hope to have a statement from them later today.

    Jack Roush is both the OJ Simpson and the Jeremiah Wright of NASCAR.

    He’s like OJ, b/c when he is caught cheating he denies it, *coughOILTANKLIDcough* even though the evidence is right in front of him. Only difference is, NASCAR doesn’t let him get away with murder.

    He’s like Reverend Wrong, b/c he spends half of his time bitching that NASCAR is trying to hold him and his team down. He wins races, but I guess it’s not enough. NASCAR is always prejudiced against his team.

    jack roush has always been against Toyota since they first came in. becuz he knows Toyota will dominate or vastly become 2nd best manufacturer in the sport…. only behind Chevrolet of course. so this is prolly something dumb and retarded. just to make Toyota look bad. Ford copied off Chevy w/ the Taurus from wheel base to wheelbase. the Taurus and Monte Carlo were perfectly the same car. with the Monte Carlo being born first obviously. jack roush team was caught a couple weeks ago cheating. so this just sounds like a big hustle over a big bunch of nothing. jack roush, i can’t wait till the day Toyota dominates and runs you out of nascar! cuz we all know Chevrolet is doing just the same. good bye roushy

    thats bull, and anything Jack had at the track that another team has not seen was probadly illegal. teams leave things around the pit stalls all the time but never anything that could be like Jack said. its not like they leave engine parts around. they leave things like spark plugs and misc parts. he is crazy he hates Toyota that much.

    Camrys are made in Kentucky, they employ 9000 americans just at that plant alone.

    Wouldn’t be the 1st time Toyota has cheated. Even when they don’t cheat they have a long history of wrecking every series they run in like CART and IMSA.

    And don’t forget them getting a hold of a Dodge from Bill Davis Racing to use for their testing when they tried getting into the Craftsmen Truck Series.

    They are still the only manufacturer to be banned/suspended from a major racing series for cheating when they got booted from WRC. I believe they have been caught stealing info in F1 too.

    1995 proved to be a difficult year for Toyota, as the team were caught using illegal turbo chargers and were given a 12-month ban by the FIA. The company returned to rallying in 1996, but its competition, notably Mitsubishi and Subaru, had a clearer advantage over their cars.

    i dont understand where Toyota are cheaters, Jack should have been stripped of those 2 Carl Edwards wins. and the deal with MWR in Daytona last season was a crew member of a rival team that messed with the 55 car, but NASCAR wont let the public know that their security in the garage area sucks after 6pm.

    Before you go jumping on Toyota’s side just remember some jobs might be provided in the US but the money goes to Japan and does not help the US economy. The other thing is we havent seen or heard the evidence. Thirdly how many US owned plants were shut down because of foreign auto makers?

    Umm US Workers getting Paid helps the US Economy more then the US CEO of Chevy being one of the only US Citizens being paid by Chevy (I’m sure their is more then one US Citizen employed by Chevy, but I’m sure you know what I mean)

    i rather have my money go to japan than to china

    American plants were shut down because they could not meet EPA standards so they when south of the border where they just pollute every river and get away with it and pay cheap labor.

    Toyota is a far superior car and has been for years, we blew them off the map in 1945 and we rebuild there country and now they have a stronger economy than we have.

    but at least we have good relations with them

    Jack Roush is an old war veteran who can’t get over the fact that Japan is no longer the enemy. The world has a new enemy with the war on terror. The Japanese are now just focused on bringing the latest and best technology to our own homes.

    As far as cheating in motorsports, every top organization cheats. There’s an old saying, “if you ain’t cheat’in, you ain’t competing”. In CART, Honda and Ford/Cosworth ‘whistled’ the mandated pop-off valve to gain an advantage of more turbo boost. In IRL, Honda tricked the black box into allowing more rpms. Every NASCAR crew chief has something up his or her sleeves every week to hopefully gain an advantage. Jack Roush probably knows every cheat and finally got caught with the oil tank lid.
    Hendrick most likely has a whole book on cheats.

    dont forget Lexus, does it matter it is just a sticker. the COT is not a GM, FORD, or DODGE. the only parts that are manufacturer related are the heads and blocks. the transmissions are from C&R. and they are no particular car except for the headlight and taillight stickers, so we dont even need manufactures anymore.

    Most race teams will cheat when and where they can to gain an advantage.
    We just don’t hear about it until they get caught. Believe me, they don’t
    always get caught. If Jack made this quote, then he’s snivelling over something
    he’s done many times himself. Whatever!
    I wish Nascar would go back to the days of old when racers would race what they
    brought and drive it til the wheels fell off. When did Nascar become a law enforcement
    agency?

    There is something to be said for “keep it simple, stupid”.

    Jack, concentrate on your own teams and their driving abilities.
    The rest of the teams need to mind their own business and keep their

    Just read the update on Jayski and it got me thinking of this…

    So let me get this straight…. RFR just brought this part to the race track, and just had it laying around the garage, and He Knows 100% that a Toyota Company representative (not a team, somebody actually from Toyota) took that part, and he has known this for a few weeks, but he has yet to take action either with NASCAR or legally, but he choose to Smear Toyota in the Media.

    So if this turns out to be false (like Ray Evernham Soaking Jeff Gordon’s tires), Toyota not only has the legal reasons to take Jack to court over this, but they also have evidence of what they would take him to court for. And I really, Really hope they take him to court, and when given the option to settle out of court, I hope they DECLINE that and Let the courts decide the case (hopefully saying to one of Jacks Business properties has to be turned over to Toyota)

    We all know he’s just as guilty and we all know that the Toyota’s have been left out on a lot of testing and informational things ON PURPOSE. I myself do not like the idea of a foreign car in an all American sport, but it is what it is and so you gotta conform. But, those teams should not be left out from things that the other teams have.

    I just wonder why Roush is using a DIVERSION tactic to get heat off of him? Did I miss something? We asll know this makes for a great diversion from someone’s OWN guilt or discovery of ill/wrong doings.

    The camry is built in georgetown Ky,I work there and its more american than the impala, ford and dodge products jack and everybody else that brings up toyota just needs to get over it,id much rather work for toyota than say ford got 2 ford plants in louisville and toyota employs more than both of them combined and pays higher wage

    look people, TOYOTA is here to stay so quit b_t_chin about it. if you dont like it find another sport to watch. i drive a scion and it has been a great car for years. better than my 2003 MONTE CARLO SS which fell apart after 3 years. My friend works at TOYOTA and makes $45. an hour making sure all the lug nuts are tight when the car comes down the assembly line. You knock TOYOTA but they give jobs to AMERICANS that were laid off from GM.

    well incase you missed it, they stole a spring from Roush racing… So unless the spring grew legs and walked across the garage then that seems to be stealing and stealing=cheating. Pretty stupid move though, they should have stole something better than that.

    Stealing does not = Cheating, I don’t know what school you went to, but if thats what they taught you should ask for a refund on your parents tax dollars.

    Also NASCAR Tears down a few cars at a time all in the same garage space. For all we know a NASCAR official could have sat the spring on the wrong table.

    you think TOYOTA stole a spring, what prove does anyone have that a spring was stolen? i guess you never seen the garage area after a race, which when this was surpose to take place, the teams leave all kinds of good stuff laying around, fans with garage passes are in there taking sheetmetal, parts, you name it, and if NASCAR checked springs after Atlanta and a roush fenway member left it on the table and a Toyota car was next it could have very well been picked up by a Toyota member. Their is no advantage to taking a spring on the COT since the rates are almost all the same.

    you know some people on here really dont get it, you sit and call Toyota teams cheaters but the only real cheaters this season are the people accusing Toyota of cheating.

    If i was Brian France and Mike Helton i would have taken Carl Edwards back to back wins away, ban the 99 car from the racetrack for 3 races and tell the Roush Fenway owners to stay home also for 3 races. they didnt deserve those wins.

    they are bold face liars and Dale Jr. and Elliott Sadler even told the media that Roush knew that taking that cover off would give them addional downforce. that lid was never found in the car and their was no debris caution for it either and thats why they didnt appeal it, so dont go calling Toyota teams cheaters because Joe Gibbs is one of the most respected owners in the garage area and as a person of great respect in the USA.

    And i hope Toyota wins every week and Tony wins the Cup just to shut Jack up forever.

    Pretty sure you’re right, but I thought it was 2 or maybe 3 springs they could run. Maybe that’s shocks, though. Who knows… It’s hard to know exactly what the deal is when the fans can’t get their hands on a copy of the actual published rules!

    Either way, it’s not like there’s some crazy secret that Toyota was going to get out of a spring, and it’s absolutely possible that an inspector just put the part on the wrong table during teardown. I wish Jack would just STFU… He’s been crying about Toyota from the get-go. I’m pretty sure everyone has had enough of it. I’m with you, Howie! The more Toyota can win and tick off Jack, I’m all for it!

    Since Roush shout off his mouth several weeks ago about this and it showed up in ESPN the mag. he now must explain himself for calling the Toyota people thieves.

    This really sounds more like Jack trying to get even with Toyota for saying he had prior testing knowledge of the benefits from letting that oil reserve box lid come off…

    Thats one thing I like about the FIA, from Formula One all the way down to the basic Showroom Stock Touring series, anybody and everybody can go onto the FIA site and get a PDF of the rule books. SCCA and the Australian V8 Supercar Series (and their developmental series) are like that as well.

    They are simply more competitive this year because they actually have drivers that can do something with the car.
    They also have Mark Cronquist as an engine builder. They learned a lot from last year’s mistakes.

    it looks like Jack is accusing a member of Denny Hamlins team of stealing a part in Atlanta when he was stalled next to David Ragans car. And Jack is not go to NASCAR but to his attorneys and the rumor is we will have another F1 scandal if NASCAR does not step in and put the breaks on this before he ruins this sport because if he tries suing JGR for 100 million the sport would be devastated and would not survive.

    it looks like Jack is accusing a member of Denny Hamlins team of stealing a part in Atlanta when he was stalled next to David Ragans car. And Jack is not go to NASCAR but to his attorneys and the rumor is we will have another F1 scandal if NASCAR does not step in and put the breaks on this before he ruins this sport because if he tries suing JGR for 100 million the sport would be devastated and would not survive.

    Sorry, but how could a lawsuit destroy nascar? I could care less if gibbs or any other team gets caught stealing. I think this whole thing has been blown out of proportion. Teams have always tried to get an advantage in NASCAR. If it it cheating or whatever it has been done before.

    Jack Roush plays the media and nascar like a drum. You may not like him but if you look at his overall winning percentage it is pretty darn good. I really do not like him but he does figure out a way to win and make money. Overall his drivers are good as well. Matt is one of the best men in NASCAR or so it seems and some of the other drivers are as well.

    I think we will find out what the part is unless it is illegal and then this will all go away.
