Carl EdwardsRoush Fenway Racing announced today that it will not appeal the penalties imposed by NASCAR following its post-race inspection of the #99 car at Las Vegas.

“We have conducted a thorough internal investigation and have found no evidence whatsoever that anyone intended for the bolt/nut fastener to fail to secure the lid for the entire race,” said Jack Roush, team owner.

“We have subsequently added protective measures to insure that the lid will remain fastened even if a failure of this type should again occur.” Geoff Smith, president of Roush Fenway Racing said, “We realize in the NASCAR system of penalty administration that simple negligence, by itself, is never sufficient grounds to overturn or reduce a penalty. Consequently, no appeal will be made of the penalties assessed by NASCAR.”

    Of course they’re not appealing it… They don’t have a freaking leg to stand on!

    Besides they would more than likely face stiffer penalties if they didnt win their case. And i agree they would have a snowballs chance in hell of winning their case.

    Well if you have found no evidence that it was on purpose then that means you must have found evidence that proves taht it was an accident, and if that is the case then you would most likely have a chance at winning the appeal…. That is unless you really do know that it was on purpose and what you are saying is just being said to try and save face on an un-face-savable subject.

    Lose the appeal and pay dearly. Not worth it. Especially if you can’t make it look like an accident. Damn, I hate it when Lee White is right!

    The part about Lee Whites comment that said through wind tunnel testing Roush new what could be gained still tells a lot about “simple negligence” on the teams part.
    If no gain or a loss was found during wind tunnel tests do you think that part would have failed so easily ?? hum, me think not.

    their is an advantage to taking that lid off, the box is open on the bottom and the tank sits inside the box, when you open that box up by taking that lid off you get additional downforce, i personally looked at it for myself today and i know i wouldnt put just 1 fastener in that lid, it should of had 3. they knew 1 fastener would not hold that lid on because their is pressure coming up from under the car that would push that lid up. as far as Rusty and fumes he is out of his mind because the system is sealed, their is a spinner cap on top of the tank.

    I think they meant exhaust fumes coming from under the car and going into the cockpit behind the driver. In my opinion the chance of that is worse than the benifit of a little down force trick with a missing cover. they have filtered air devices , but exhaust gases can still get to the driver in some amounts. Rick Mast retired from effects of breathing exhaust gasses.
