Kyle BuschNASCAR has issued penalties and fines to the #5 and #70 teams that compete in the Nextel Cup Series, as a result of rule infractions found this past weekend at New Hampshire International Speedway in Loudon, N.H.

Both cars, the #5 Chevy driven by Kyle Busch and the #70 Chevy driven by Johnny Sauter, were found to be in violation of Sections 12-4-A (actions detrimental to stock car racing); 12-4-Q (car, car parts, components and/or equipment used do not conform to NASCAR rules); and 20-12.8.1B, COT Technical Bulletin #3, dated 4/10/07 (failed to meet the minimum front car heights) of the 2007 NASCAR rule book. The violations were found during post-race inspection last Sunday.

As a result, Kyle Busch and Sauter have each been penalized 25 driver championship points. Their respective crew chiefs, Alan Gustafson and Robert ‘Bootie’ Barker, have each been fined $25,000 and placed on probation until Sept. 19. In addition, Rick Hendrick, owner of the #5, has been penalized 25 car owner championship points as has Joe Custer, the owner of the #70.

    i hate to say this but gordon and johnson got screwed because kyle failed post race inspection, and it was only re race inspection where jeff and jimmie got hit hard

    Way to go Nascar.

    Hit Gordon and Johnson hard because they failed pre-race inspection and let them have legal cars on the track.

    Give Kyle Busch and Johnny Sauter a little point reduction because they were racing a car against the rules during the race.

    Way to be fair.

    Is the racing season over yet? Nascar really needs to look at what they have done this year and make damn sure they don’t pull this crap next year.

    Personally I think they never should of set the bar for pentalties with
    the COT so high to begin with, because now if they follow their trend
    they’re being too stiff and if they don’t they’re being inconsistent.
    It’s pretty much a lose-lose situation for them unless Brian France
    would actually grow some cahones and say hey, yeah, I f__ked up. But
    he’s not man enough to do that, so I’m waiting to see just how far
    downhill he drags Nascar this time. He’ll be sitting in satan’s lap
    with a Sprint sign in hand soon enough.

    Granted, I am still new to NASCAR, so I do not really know all that much about it yet.

    I am a huge Sauter fan and even I found the penalty to be a little lenient. After the 24 and 48 were penalized, and like Chris said about the car actually being raced, I really thought a heavier penalty was going to come out of this.

    While these penalties seemed way too lenient to me, I don’t think that the penalty for these infractions should be as harsh as those of the 48, 24, and even the 8 back 6 races ago. This is more like the situation that Gordon had back in Daytona. His car had an height issue after he he won one of the qualifying races and he had to begin at the back of the pack for the 500 itself. He didn’t loose points for that, nor did anyone get fined or suspended. So, by putting the cheifs on suspension and fining points and money, they are enforcing things a bit harsher for the COT. Gordon and Johnson’s car issues were much more comparable to that of Junior except as Kyle Petty said during that weekend it was more of a deliberate attempt to tweak things and bend the rules, whereas Jrs issue was seemed to everyone involved to ba more of an honest mistake. Kyle Petty predicted that the penalties would be similar and the added start at the back of the pack seemed to be appropriate for the fact that it was a little more planned than Jrs issue. Whether it realy was accidental or not or the 8, only Tony Eury Jr knows for sure, but, even though NASCAR seeemed to think it might be a mistake, they gave him a penalty that set the standard for what to expect in the future.

    SO BASICALLY IF YOU GET CAUGHT AFTER THE RACE YOU GET A SLAP ON THE WRIST …AND BEFORE THE RACE THE YOU GET THE HAMMER BROUGHT DOWN ON YOU.. I AM NOT A GORDAN OR JOHNSON FAN BUT I LOVE MY JR…AND IT SEEMS LIKE THOSE 3 DRIVERS PLUS A SELECT FEW OTHERS ARE AWAYS GETTING THE BIGGER PENALTIES…AND THE REST OF THE GUYS GET A SLAP ON THE WRIST…THATS JUST HOW I SEE IT…THEY NEED TO MAKE UP THEIR MINDS ABOUT THE PENALTIES AND EVERYONE SHOULD GET THE SAME THING.

    Are you kidding me NASCAR?! the 8, 24, and 48 cars got docked a 100 points. And you give these two only 25?! Why does it seem like they give the favorites more points docked than the, lets just leave it at that. They broke about 3 violations. And JR only had illegal brackets. Whats that gonna do? Lets face it, NASCAR has changed for the worse.

    Stuff happens during the race. Parts fail, springs collapse, fenders get moved. Yes they didnt pass post race inspection but they did pass pre race inspection. If you unload the car from the trailer and it doesnt pass inspection, then you shouldnt be able to race. That is blatently breaking the rules. As soon as teams start getting parked and losing sponsorship money they will get curtail the cheating. Thats just my 2 cents.

    The 5 and 70 infraction was caused by the cars settling due to being raced. The 24 and 48 were out of the rules cause their cheating ass crew chiefs purposely adjusted the febders that way BEFORE they were on the track. Theres the difference.

    Didn’t Kyle and Johnny have illegal parts?
    (strange that two seperate teams, have the
    same rule infraction) It only took JJ and JG’s
    teams 15 minutes to correct “France’s” violation
    before the race. Soon—-we’ll have a “TIGHT”
    point championship. JJ and JG had more points
    to take away, than and JS and KB.

    I would like to make a comment on these penilitys but I’m afraid Brian France will dock me 100 “Fan Points for a violation of rule 12-4-A. AAAHHHH screw it I think Brian is trying to step out from his dads shadow and put himself out in the lime lite by being so crazy in these penilitys and talking crap about stiffer ones.

    These penalties are silly, what difference does it make when the #48 had a crew chief suspended and the diver fined last year they come back a year later and only get slapped on the wrist again. The 24 car was caught i before Datona and only set to the back of the pack and the again mid way through the chase. The fines since it was the second offence ithey should have been slapped with negative points for the final go around, now it does not affect anything when the final chace begins.

    GOOD answer to ding dong and Justin ! I agree with you…things CAN happen to a car during a race ! I think the penalities were fair. HELLO..the reason Gordon and Johnson got slammed was they messed with the car BEFORE the race !

    lets just remember what the penalties were for both cars were 1/8 of a inch too low, i dont like either driver but this stinks to find out there is only an 1/8 of an inch tolerance lets face it these cars can settle 1/4 to 1/2 of an inch during a race so how many teams are going to run into the same problem nascar has really dropped the ball on this one

    these penalties are so not fair. im a gordon and johnson fan and i think there penalties was bull crap also. mr france needs too get his head and brian checked i think there is something wrong with him and the rest of the guys that work for him cause they all nuts too me.

    What I am wondering is this: Where is the fine the same, which is what they said they were going to be handing down the same fines for all those who basically break the rules for the COT. Consistant here, I think not!
