A Miami law firm announced its plans Monday to file a lawsuit against a NASCAR driver accused of assaulting a 62-year-old security guard at the Homestead-Miami Speedway last month.

UPDATE:
Kahne, still in his driving uniform, attempted to walk around the guard and, according to the spokesman, the two bumped and, when Kahne turned around, the guard was on the ground.
Police were called and Kahne spent several minutes in handcuffs before being released. The security guard was checked and released at the infield medical center.
A police spokesman said the incident is under investigation by detectives and he was not at liberty to talk about specifics.
Kahne took part in Saturday’s Cup practices and will start Sunday’s season-ending Ford 400 third in the 43-car field.

Nextel Cup driver Kasey Kahne is under investigation by the Homestead Police Department for pushing a track security guard to the ground Friday before the Craftsman Truck Series race at Homestead-Miami Speedway. A conflict ensued between Kahne and the security guard after Kahne could not provide the proper credential for his brother, Kale Kahne, in order to enter the drivers’ motorhome lot inside the speedway, according to Police Capt. Tom Foglia.
After the incident, Foglia said, the security guard complained his blood pressure had escalated. An emergency vehicle was called and the security guard was taken to the infield care center. Foglia did not have the name of the security guard or his condition as of early Saturday afternoon.
“We are looking into the matter; the detective is handling it,” Foglia added. After Cup practice on Saturday, Kahne said, “It was all a misunderstanding.” NASCAR officials are aware of the incident and said the sanctioning body will not take action until the local police conclude their investigation. “We can’t comment on that right now,” NASCAR spokesman Kerry Tharp said.

From knowing Kasey, I find it hard to believe that the incident was nothing more than Kasey laughing the guard off. I would find it more believable that it is nothing more than another incident of someone looking to make a quick buck!

I agree Paul. The people they find to “guard” the entrance to the off limit areas to you and I, are not the highest of calibur. Someone looking to make a name for himself I am sure. Who cares if he had the right credentials. If he is with Kasey I am sure it’s ok for him to go to his coach with him!! What a joke! Now if Kale was trying to get in and not standing or with Kasey, then I could see a problem. This guy needs to get a life. Not like he’s guarding the entrance to the White House!!

I’m not a security guard but I’m pretty sure if a driver walks in with someone, hmmm, they should be allowed in. The guards are there for the drivers, no? So really, the guard should have listened to Kahne because the only reason he has a job is because of the DRIVERS.
Even better is that Kahne pushed a man down. Have any of y’all stood right next to Kasey? He’s as small as a high school cheerleader. The guard’s pissed that HIS image is screwed.
That is just funny. I couldnt see Kasey doing anything like that. He is so sweet and I think that the guard is full of $hit. I agree with you guys that he shouldnt be a guard if his blood pressure is going to rise in a stressful situation and that the guard is just trying to make a quick buck.

To the people that are saying they should have let his brother in because he was with a driver. Well lets not forgett that several times this year things have been stolen from the motorhome/garage areas, so security is really tight.
Heck when I was at Pocono this year Brian France had to show his credentails to be allowed into the press center.

I think its kinda wierd that everybody assumes a security guard is a rent a cop. Around here when a big event needs security our police department has a special group of people that are like security guards, but they are also full time cops. They are called the “LAPD Security Force”
Have any of your ever seen Kasey in person. On a good day he may weigh 95 lbs. Anyone that could be knocked over by Kasey has no business being a security guard.

If you are a cop or security in any way…a job where there may be some physical involvement…shouldn’t you be free of all medical problems? Come on, you guys - the guard was only doing his job. Like most people in that position, they have no idea who the drivers are and what they look like. Maybe NASCAR should furnish them with a photo page or something that would help the guards ID the important people they can let pass. One year at Las Vegas I was talking to a guard we had seen several years in a row in the infield when Ned Jarret went by and tried to enter a door that was secure. Ned didn’t have his pass on him, but I identified him to the guard and told him it was okay to pass Ned through. Based on his relationship with me and knowing that I was truthful, the guard let Ned pass without a hitch. Kasey knows the rules about ID and infield passes, though, and should have cut the guard a break until the problem could be resolved, either through a check with the security office or supervisor or a NASCAR rep. Wonder where the brother’s pass was and why Kasey just didn’t go get it or get a new one issued. Or maybe NASCAR should hire me to identify people to their security guards….hint, hint :o)
The guard’s BP complaint might have been legit but appears to be a bogus way to cash in on the situation. Shame, shame.
So, it’s been a while now, and no news. I have a cousin who works at Homestead, and he was saying that they found some witnesses that told the police that Kasey got around the guard, and the guard came running after him, then fell down on his own accord.
And seriously. If that guy had blood pressure problems, he shouldn’t even be a security guard.
Why should Kasey go to jail? These little attention getters are the reasons why rapists and murders are being set free to make room for this. It be diffrent if Kahne shanked the guard. AND besides Kahne would NEVER hurt anybody, hed give you the shirt off his back for you anytime.
150 LBS wet maybe, 130 LBS dry, ha, ha, Kasey isn’t bad enough to knock the heck out of someone, When I fall down I get Pi$$ed and can feel my blood pressure go up, that’s all the guard is doing, and probably felt when he got pi$$ed for falling, trying to make a quick buck, he’s probably ready to retire and cannot afford to retire until he can figure out financially how he can afford to retire, maybe he just figured it out, sue someone for the heck of it.
