NASCARDavid Scott, a black motorcoach driver who worked for Penske Racing, has re-filed his discrimination complaint against NASCAR stemming from a highly publicized 1999 incident at New Hampshire International Speedway. The incident occurred when Scott was greeted by a pair of motorcoach drivers, one of whom was wearing a white pillow case over his head as if he were a member of the Ku Klux Klan.

NASCAR indefinitely suspended the two motorcoach drivers involved. Scott claims NASCAR and sister company International Speedway Corp. discriminated against him by not granting him a vendor contract he sought and that NASCAR discriminated against him for not following through with an alleged promise to hire him following the incident.

The new suit, filed in U.S. District Court in New York, lists NASCAR, ISC, NASCAR President Mike Helton and former Chief Operating Officer George Pyne as defendants and claims $40 million in damages. Scott had to re-file the lawsuit after a judge ruled in January that the statute of limitations had passed for other allegations. The new complaint details conversations between Scott and Helton and Scott and Pyne in the days and months after the incident where he says he was promised a job by NASCAR.

In past court filings, NASCAR says that Scott was given several work opportunities that were declined and he was not qualified for the racing official job he wanted. In the new complaint, Scott alleges that NASCAR and ISC conspired with Penske Racing to keep him from suing - he had signed a severance agreement with Penske where he was given a two-year severance package as long as he didn’t talk about the incident nor sue. He alleges the confidentiality agreement was broken because Pyne knew about the agreement. Scott claims damages of $10 million and asks for punitive damages against NASCAR, ISC, Pyne and Helton of $27 million. He indicated he also has incurred legal costs of $3 million.

    So what is the other side of the story? Did the 2 former motorcoach drivers do this as a simple practical joke, or was there some on going feud between these 3? Sounds like a $$ grab to me.

    So why exactly does this guy deserve 37 million dollars? He would not have made that much being the motor coach driver (and if he would’ve I guess I best go become one)… l0l

    I just want to know what he wanted the Vendor contract for, as this is the first time in this whole mess of a situation that him wanting a vendor contract was mentioned.

    Like it says in the Article, NASCAR agreed to give him a job, they offered him jobs and he didn’t take it because he wanted to do something he wasn’t qualified for.

    People like him are the way the world is the mess that it is today, always wanting something just because of who they are not because of what they are able to do.

    i remember this , it was funny as hell , i cant believe a practical joke is still goin on , oh well we have done crazier things , like dropping Michael off at a pond so he could find his way back to the motorcoach in the middle of the night. this is NASCAR. if you cant hang with the big dogs, get off porch.

    This guy is an idiot! Does he really think that he deserves ANY job he wants just because of this… “incident”? Give me a break, he wanted to be a big boy and he didn’t get his way, so now he’s gonna sue. Yawn.

    Oh and why wouldn’t the CEO KNOW about the “deal”? That does not qaulify under “confidentiality” if he was in it from go.

    Just another moron trying to use race as a step up instead of working for it. Obviously, he wasn’t qaulified for the postions, so you don’t get it just because your “black” or because your feelings got hurt because you walked in on a joke from two otehrs and automatically took it THAT way. IF that even really happened that way.

    I mean come on, sounds fishy to me. A lot of people say Nascar is a “redneck” sport, implications leading to “southern” mentalities, thus automatically meaning everyone in/around nascar is racially biased. What a crock. The guy is looking for an open hand. Jackass.

    This will be settled out of court for roughly 45% as usual it’s just another nuicense (forgive the spelling) lawsuit. It’s cheaper to pay him than to fight him in court.

    I agree it should be settled out of court for about half of what he’s claiming. It may have been a practical joke but sometimes they go too far and personally I would never do that! The Klan is not a joke. I have some African-American in my pedigree and my great grandmother who was from Tennessee via North Carolina told me stories when I was a young girl about the Klan that to this day make my hair stand up on the back of my neck. It’s not a laughing matter.

    it was a practical joke and know one when too far , its completely blown out of context, we are one big family out here and everyone of us are friends. all the motor coach drivers get to the compound on wed or Thur and clean polish and setup everything for the driver when he flies in and they pick him up from the airport. until the driver gets there everything is laid back we drink beer usually and cook and have fun. this incident that happened was a joke. Dave was the only black coach driver on the circuit and it was a stunt that he didn’t like and this is what happens. i guess he never really liked his job anyway. he felt he was to good to be going grocery shopping for his boss, and polishing wheels and emptying the holding tanks on Monday. good riddins Dave.

    Buy a lottery ticket to win jillions like everyone does my friend. NASCAR ain’t your lottery source Scottie. Maybe us poor NASCAR fans can charter a motorcoach and you can drive it for us. We’ll load it up with Brian Bud Selig France, Mike “Fat Elvis” Helton and John “Homer Simpson” Darby. Then the four of you can hit the highway and just keep going. Don’t look back OR comeback. Just go away!
