Rick Hendrick and Earnhardt, JrHendrick Motorsports will not be able to purchase the No. 8 from Dale Earnhardt Inc., nor is DEI allowed to sell it to Hendrick or any other team.

NASCAR on Monday reiterated its long-standing policy that the sanctioning body owns and assigns all car numbers, and spokesman Ramsey Poston said a team cannot sell its car number to another team on its own accord.

“NASCAR owns the numbers and licenses them to teams on an annual basis,” Poston said. “A team may allow another team to use the number for that year pending NASCAR’s approval.” The numbers, however, are not for sale, Poston said.

Poston said each year a team submits numbers it wishes to use. If a team has been using that number, it is generally reissued. If a team chooses to relinquish the number, the number returns to NASCAR and it will assign it to another team that has requested it. NASCAR plays no role in why or how a team decides to no longer request a number’s use.

Asked if a team could make a financial arrangement with another team to encourage it to give up the use of a number, Poston said NASCAR would discourage such arrangements.

    hmm.. and they waited so long to tell us this because….
    I didnt know how the process of numbers were distrubuted
    but we’ve been talking about the selling and buying of the 8 for how long.
    Nascar should have said something sooner about how the process worked

    Kaydee, when Dale announced he was moving to Hendrick, NASCAR made light of the fact that they issue the numbers, and how they issue the numbers (on Dialed In with Claire B. Lang).
    On another note, If enough stink is made (by the fans) than maybe NASCAR would issue the number to the new team with out any deals being made. Personally I don’t care what number he drives, or who he drives for, or what is on the side of the car it is the driver i pull for.

    Nascar cant stop a deal being made that would have DEI give up its clame to use the #8 and if it becomes available hendrick can apply for it befor the season starts. What Nascar is saying is that they own the #8 so DEI cant just sell it to Hendrick and it be his the # has to be available for use and has to be applied for to use by a team

    If I remember correctly didn’t Sr get the number 8 from another team the had the rights to it. The number 8 is known as Jr’s number and was his grandfathers number he should be able to use it.

    Kaydee… It was discussed, on here atleast, back a couple of weeks ago… The first paragraph is straight out of the elusive rule book and the second is the author of the article’s own commentary.

    “20-3.11 of the rule book — (2) All NASCAR Nextel Cup Series car numbers are owned by and will be assigned by NASCAR for use by the car owner. Car numbers are not transferable or assignable by the car owner. Numbers on a car competing in the Series must correspond with the car owner’s license that is one file at NASCAR headquarters, unless otherwise authorized by NASCAR.

    “Nope, NASCAR isn’t going to play this numbers game. If Hendrick and DEI come to an agreement, NASCAR most likely would agree to swap the numbers. If not, the sanctioning body could open up a can of worms by making the switch without everyone being on the same page.”

    personally i think that jr should get different # so he can start fresh with HMS new team, new # get out from under shadow of DEI granted fans will have to buy new stuff but think of how fast the stuff will sell everybody will want to be 1st person to buy that die cast, hat etc

    Wow, this is a bunch of crap and NASCAR Officials are really flexing their muscles here. This is rediculious. I hope something works out for Jr. to have the number eight with him. We will have to see with what is in the rule book and what happens with the number then I guess and lets all hope that NASCAR does the right thing!

    What is best for NASCAR to to let the teams figure it out. The best thing would be a totally new number, and sell some new merchandise.

    I am a HUGE Dale Jr fan and I feel he made the “#8″ what it is today and that this #
    belongs in the family…..as said previously, his grandfather drove it and Dale Sr. gave
    it to Dale Jr. To me Teresa is NOT A TRUE EARNHARDT, she is by name only and that can
    be changed back to her maiden name…….Dale Jr IS AN EARNHARDT through and through
    and NO ONE NOT EVEN TERESA can take that from him……I don’t know about anyone else
    but I think she is a STIFF ASS WITCH with a B.

    i think that its soo true teresa is not a real earnhardt i believe what no1dalejrfan4ever says its sooo true….shes only a earnhardt thru marriage thats it but otherwise shes not a earnhardt and i think that dale jr deserves 2 keep the car 8 that hes been drivin 4 all these years….its his dads company that he should stay in and all…i think the reason y he wants 2 leave his cuz his step mom is treatin him like hes not part of the family well he is a TRUE EARNHARDT NOT TERESA!!!dale we back u up on u keepin ur car!!! i am a major fan of him…..
