Mayfield case won’t be decided until next summer

The Jeremy Mayfield-NASCAR saga in U.S. District Court likely won’t be decided until at least next June, and that doesn’t take into consideration possible delays and additional appeals.
As both sides await decisions from the U.S. District Court in Charlotte and the U.S. Court of Appeals in Richmond, Va., on whether an injunction that lifted Mayfield’s suspension should remain in effect, the sides have agreed to a preliminary schedule of how the case will unfold. The injunctions are rulings that are in effect until the case is fully investigated and then heard in court.
According to a filing Friday in U.S. District Court, all discovery – the investigations by attorneys that include deposing of witnesses – is supposed to be completed by April 7, 2010. All motions for summary judgment should be made by May 7 with responses due May 28.
Any trial would follow the ruling on summary judgment, which likely would require a hearing sometime next June. Both sides indicated a settlement is unlikely and any mediation to achieve a settlement should follow the summary judgment phase.
A trial in the case would be expected to last five to seven days.
Any decisions on a summary judgment or from the trial can be appealed.
The dates filed Friday are initial deadlines and can be extended by the court.
Good luck to all parties you’ll need it in the federal courts. They move very slow. I just hope both sides just stop the mud slinging as well as others who say they know but don’t. Let it play out and reserve judgment until then. Lady Justice is not blind but her sword swings slowly.

You know Earnhardt once told a young Gordon that it doesnt matter if they boo you or cheer you…Atleast they are talking about you!!! I think Jeremy might of taken that speech a little out of context… Cause we sure are talking about him now. Its crazy, Martin comes back and is kicking butt, Stewart is 1st in points as an owner/driver and Earnhardt and Eury are no more but this guy gets all the headlines!!! Genius on Mayfields part!!!!

u know what this is rediculous. everyone thinks they know whats going on, believing nascar, and all that. for just one moment stop and think, what if jeremys telling the truth, the judge had to have seen something that u the reader hasnt. so on that note think of what if u where the one someone wrongly accused? how would u feel? and now instead of it just being confined to people u know. they put it nation wide. people please think the way things are suppose to work is innocent till proven guilty. and im sorry nascars word on things is not been 100% fact in the passed. yes even the mighty nascar has been wrong! so all im saying is before u talk and/or argue with this remember what we think doesnt really matter to nascar, or a court. so instead of bad mouthing someone. remember the rule everyone should live by treat others like u want to be treated.
I don’t see both sides staying the course..
the more NASCAR drags its feet the higher Mayfields legal costs will be.
I don’t think he’ll be able to hold out for 11 months (plus all the delays associated with different motions from each side.)
Hitler was an evil genius but no one really wants to be like him,do they? Give Mayfield credit for standing his ground. I’ve been saying NASCAR wants to get rid of single car teams (Long,Robby, Nemnuts,Mayfield,Baldwin, MM#4) because they are a nuisance. They stand up for themselves and actually want equality. NASCAR has contempt for people/teams like that.

Their a lot of things all of you are overlooking. First, When Terry Mayfield died, He hadn’t talked to Jeremy in along time. Basically Jeremy and his dad never got along and didn’t speak Second, Lisa Mayfield can give times and dates of when he smoked METH, Its not just a statement saying she saw him do it. One time she had said was after a awards banquet for Ray. Another time was at a race in Darlington. Third, Jeremy’s independent lab samples that have tested negative aren’t up to the National Standards and weren’t specifically testing for METH. Fourth, Was there a witness present when he gave his samples. 5th, Jeremy said he and his lawyer was heading down to file a wrongful death suit against Lisa on Thursday, but now it is Monday and still no lawyer has gone to any courthouse in Cabarrus County to do it. He is a con and a good one. Anyone that believes him is just as crazy as he is.
